Tenancy Deposit Protection: The 30-Day Rule, Schemes and Penalties
Deposit protection looks simple, but it generates more tenant claims than almost any other compliance rule - because the penalties are automatic and the deadlines are short. Miss the window or forget the prescribed information and you can owe the tenant up to three times the deposit, even if you did nothing else wrong.
The deadlines
Under sections 213–215 of the Housing Act 2004, you must protect the deposit in a government-approved scheme and serve the prescribed information within:
| Nation | Deadline to protect |
|---|---|
| England & Wales | 30 days from receipt |
| Scotland | 30 working days from the tenancy start |
| Northern Ireland | 28 days from receipt |
The clock starts when you receive the money (England and Wales), not when the tenancy starts - a common and costly misunderstanding.
The approved schemes
There are three approved schemes in England and Wales:
Each offers two models: custodial, where the scheme holds the money for free, and insured, where you keep the money and pay a fee to insure it. Scotland and Northern Ireland have their own approved schemes.
Don't forget the prescribed information
Protecting the money is only half the job. Within the same deadline you must serve the tenant (and anyone who paid the deposit on their behalf) the prescribed information, which includes:
- The name and contact details of the scheme.
- The deposit amount and the property address.
- How the deposit is protected and how it will be returned.
- What to do if there is a dispute.
Courts treat failure to serve the prescribed information just as seriously as failure to protect the deposit itself. There's a compact definition of prescribed information in our glossary if you need to share one with your team.
The penalties
- A financial penalty of 1× to 3× the deposit, awarded to the tenant by the court.
- A weakened possession claim: Section 21 “no-fault” notices were abolished on 1 May 2026 under the Renters' Rights Act, so possession now runs through Section 8. An unprotected deposit or outstanding prescribed information still exposes you to financial penalties and can undermine that claim.
At the end of the tenancy
Deductions must be fair, evidenced and agreed. If the tenant disputes them, the scheme's free dispute-resolution service decides based on the evidence - which is why a thorough inventory and check-out report, with dated photos, is worth the effort.

Frequently asked questions
How long do I have to protect a tenancy deposit?
In England and Wales you must protect the deposit in a government-approved scheme within 30 days of receiving it, and serve the prescribed information to the tenant within the same 30 days. Scotland allows 30 working days and Northern Ireland 28 days.
Which deposit protection schemes are approved?
In England and Wales the approved schemes are the Deposit Protection Service (DPS), MyDeposits and the Tenancy Deposit Scheme (TDS). Scotland and Northern Ireland have their own approved schemes. Each offers a custodial (free) or insured option.
What is the penalty for not protecting a deposit?
A court can order you to pay the tenant between 1 and 3 times the deposit amount, and you must return the deposit before you can rely on certain possession grounds. Section 21 'no-fault' notices were abolished on 1 May 2026, so possession now runs through Section 8 - and an unprotected deposit or missing prescribed information remains a costly compliance failure that can undermine a claim.
What is the 'prescribed information'?
It's a set of details you must give the tenant: which scheme protects the deposit, the deposit amount, the property address, how to get the deposit back, what happens if there's a dispute, and the scheme's dispute resolution process. Serving the deposit without the prescribed information is still a breach.
