Landlord licensing in Burnley

Landlord licensing in Burnley: selective licensing, how to apply, fees where published, and the penalty for letting unlicensed. Last checked 18 August 2026.

Mandatory HMO licensing

In England a property needs a mandatory HMO licence if it is occupied by 5 or more people forming 2 or more households who share a kitchen, bathroom or toilet. That threshold is national - it applies even where the council has no additional or selective scheme. That rule is set by the Housing Act 2004, Part 2 and applies in Burnley whether or not the council also runs additional or selective schemes. GOV.UK HMO licence guidance.

Additional HMO licensing

No designation independently verified as in force on the review date. Confirm with the council before assuming a property is out of scope - schemes launch, expand and lapse with little notice.
