Does Rent Smart Wales Apply to My Situation?
Rent Smart Wales is the question English landlords ask the week they buy in Cardiff or Swansea. The short version: if the home is in Wales and it is privately let, the scheme applies. It is not optional, and it is not the same as an English selective-licensing designation.
Who it covers
Under the Housing (Wales) Act 2014, a landlord of a rental property in Wales must register with Rent Smart Wales. Anyone who carries out letting or property-management work at that property must hold a licence and complete approved training - or the landlord must appoint an agent who already holds one.
“Letting work” includes advertising, viewing and creating the tenancy. “Management work” includes collecting rent, arranging repairs and ending the tenancy. If you do those things yourself, you need the licence. If a licensed agent does them, you still register as the landlord.
When it usually does not apply
Social housing, genuine holiday lets that are not a person's only or main home, and some family arrangements sit outside the scheme. Borderline cases (a lodger in your only home, a long-term Airbnb, a company let) are worth checking on the Rent Smart Wales guidance rather than guessing. The default for a standard private tenancy in Wales is: it applies.
HMO licensing still sits on top
Wales also uses the Housing Act 2004 for HMO licensing. A five-person shared house in Cardiff can need a council HMO licence and Rent Smart Wales registration and a licence. See the Cardiff licensing page and the council directory for local HMO schemes.
If your other stock is in England
The PRS Database will be the English national register when it opens. It does not replace Rent Smart Wales and it does not apply to Welsh properties. Keep the two regimes separate on the record.
Vantage flags Rent Smart Wales when a property is set to Wales, alongside gas, electrical and deposit duties. The licence itself is issued by Rent Smart Wales, not by us.
Frequently asked questions
I live in England but let a flat in Cardiff. Do I need Rent Smart Wales?
Yes. The scheme follows the property, not the landlord's address. Register the Welsh property and either take a licence yourself or appoint a licensed agent to do the letting and management work.
What is the difference between registration and a licence?
Registration is the landlord's record of who they are and which properties they let. A licence is required for the person or firm that actually advertises, views, tenancy-signs or manages. A landlord who uses a licensed agent can register only; a self-managing landlord needs both.
Does Rent Smart Wales replace an HMO licence?
No. Local-authority HMO licensing under the Housing Act 2004 still applies in Wales. You can need Rent Smart Wales registration, a Rent Smart Wales licence and an HMO licence for the same house.
